A procedure of dispute resolution available when a liability insurer wrongfully fails to defend. The abandoned policyholder may cooperate with the injured plaintiff to settle their liability dispute by an adjudication of the issues of liability and damages, followed by a suit against the defaulting insurer, supported by a conclusive presumption of liability and damages.
